Terms of Use

Acceptance of Terms

Welcome to PingMind. By downloading, installing, accessing, or using the PingMind application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and LimStack (“we,” “us,” or “our”).

Description of PingMind

PingMind is a personal reflection and self-awareness application for iOS that enables you to:

  • Create Custom Questions: Design your own reflection prompts for daily, weekly, and monthly reviews
  • Record Reflections: Capture your thoughts using various answer formats:
    • Yes/No (Boolean)
    • Numeric Values (Numbers)
    • Free-Form Text (Text)
  • Track Progress: Visualize your reflection history through:
    • Calendar views for daily reflections
    • Charts for numeric data
    • Lists for text and option-based answers
  • Sync Across Devices: Optionally sync your data across your Apple devices using iCloud
  • Export Data: Export all your reflections as JSON files in a ZIP archive
  • Set Reminders: Receive optional notification reminders to complete your reviews

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on devices that you own or control
  • Use the App for your personal, non-commercial purposes

License Restrictions

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.) on the App
  • Use the App for any commercial purpose without our express written permission
  • Use the App in any manner that violates any applicable laws or regulations
  • Use the App to store or transmit any unlawful, harmful, or offensive content

Your Responsibilities

As a user of PingMind, you are responsible for:

Device and Account Security

  • Maintaining the security of your iOS device (passcode, Face ID, Touch ID)
  • Safeguarding your Apple ID and iCloud account credentials
  • All activity that occurs through your device and accounts

Content You Create

  • All reflection questions and answers you create and store in the App
  • Ensuring your content does not violate any laws or third-party rights
  • The accuracy and appropriateness of your reflections

Backups

  • Creating backups of your data using the Export feature
  • Maintaining copies of important reflections
  • Understanding that we are not responsible for data loss

Compliance

  • Using the App in compliance with all applicable local, state, national, and international laws
  • Not using the App for any unlawful or fraudulent purposes

Intellectual Property Rights

Our Rights

The App, including its design, functionality, source code, features, user interface, graphics, and all related intellectual property, is owned by LimStack and is protected by:

  • Copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • Other intellectual property rights

Your Rights

You retain all ownership rights to the content you create in the App, including:

  • Your reflection questions
  • Your answers and reflections
  • Any personal data you input

We claim no ownership over your content. Your reflections belong to you.

Trademarks

“PingMind” and related logos are trademarks of LimStack. You may not use these trademarks without our prior written permission.

Privacy and Data Protection

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

  • No Data Collection: We do not collect, access, or analyze your reflection data
  • Local Storage: Your data is stored locally on your device using SwiftData
  • Optional iCloud Sync: You can optionally sync data to your personal iCloud account
  • No Servers: We do not operate servers that store your data
  • Your Control: You have full control over your data with export and delete capabilities

iCloud Sync

Automatically Enabled by Default

iCloud sync is automatically enabled by default to keep your data synchronized across your Apple devices, but you can disable it at any time.

Apple’s Service

iCloud sync uses Apple’s CloudKit service. By using this feature, you agree to:

  • Apple’s iCloud Terms and Conditions
  • Apple’s Privacy Policy
  • Store your data in your personal iCloud account

Our Role

  • We do not have access to your iCloud data
  • We do not control Apple’s iCloud infrastructure
  • We are not responsible for iCloud service interruptions or data loss

Your Responsibility

You are responsible for:

  • Maintaining adequate iCloud storage space
  • Managing your iCloud account and Apple ID
  • Understanding iCloud’s data retention policies
  • Disabling iCloud sync in Settings if you prefer not to use the feature

Notifications

Optional Feature

Notification reminders are optional and can be enabled/disabled in Settings.

Local Notifications

  • Notifications are scheduled locally on your device
  • No data is transmitted to our servers (we don’t have servers)
  • You can customize notification time and frequency

iOS Permissions

You control notification permissions through iOS Settings.

Data Export

The App includes a feature to export all your data:

  • Format: JSON files in a ZIP archive
  • Contents: All questions, answers, reviews, and timestamps
  • Purpose: Backup, portability, or migration
  • Your Responsibility: Store exported files securely

Disclaimers and Limitation of Liability

”AS IS” Provision

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY OR FREEDOM FROM VIRUSES

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIMSTACK, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • LOSS OF OR DAMAGE TO REFLECTIONS OR PERSONAL DATA
  • COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES
  • BUSINESS INTERRUPTION
  • PERSONAL INJURY OR PROPERTY DAMAGE

This limitation applies whether based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability, our total liability to you for all claims shall not exceed the amount you paid for the App (if any).

Not Professional Advice

PingMind is a personal reflection tool and does not provide:

  • Medical advice or mental health treatment
  • Professional counseling or therapy
  • Legal, financial, or any other professional advice

Do not rely on the App as a substitute for professional advice. If you need help, please consult qualified professionals.

User Conduct

You agree not to:

  • Use the App to store illegal content or content that violates third-party rights
  • Attempt to gain unauthorized access to the App or related systems
  • Interfere with or disrupt the App’s operation
  • Use automated systems (bots, scripts) to access the App
  • Violate any applicable laws or regulations while using the App
  • Abuse the feedback/support email system

Third-Party Services

Apple Services

The App integrates with Apple’s services:

  • iOS: The operating system platform
  • SwiftData: For local data storage
  • CloudKit: For optional iCloud sync
  • User Notifications: For optional reminders
  • MessageUI: For sending feedback emails

These services are governed by Apple’s terms and policies. We are not responsible for Apple’s services or any issues arising from their use.

Firebase Crashlytics (Google)

The App uses Firebase Crashlytics to collect crash reports and improve app stability:

  • Purpose: Automatic crash reporting and performance monitoring
  • What it collects:
    • Crash reports with stack traces
    • Device model, iOS version, and app version
    • Anonymous installation UUID
    • Basic performance metrics (launch time, screen load times)
  • What it does NOT collect:
    • Your reflection questions or answers
    • Any personal content you create
    • Your name, email, or personally identifiable information
    • Your iCloud data
  • Data retention: Crash data is typically retained for 90 days
  • Your control: Crashlytics runs automatically to help us fix bugs. To opt out, you would need to stop using the App
  • Privacy: Subject to Google’s Privacy Policy and Firebase Terms of Service
  • Data location: Stored on Google’s secure servers

By using the App, you acknowledge and agree that crash reports and performance data will be collected through Firebase Crashlytics.

No Analytics or Advertising

PingMind does not integrate with any analytics platforms (like Google Analytics) or advertising networks. We only use Firebase Crashlytics for crash reporting to improve app stability.

Updates and Modifications

App Updates

We may release updates to:

  • Fix bugs and improve performance
  • Add new features
  • Enhance security
  • Ensure compatibility with new iOS versions

Updates may be provided through the App Store and may be necessary for continued use.

Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the “Last Updated” date
  • Providing notice within the App
  • Posting on our website

Your continued use of the App after changes constitutes acceptance of the new Terms.

Service Modifications

We reserve the right to:

  • Modify or discontinue features
  • Change the App’s design or functionality
  • Cease offering the App

We will make reasonable efforts to notify users of significant changes.

Termination

By You

You may stop using the App at any time by:

  • Deleting the App from your devices
  • Disabling iCloud sync (if enabled)

By Us

We may terminate or suspend your access if you:

  • Violate these Terms
  • Use the App in a manner that could harm us or other users
  • Engage in fraudulent or illegal activities

Effect of Termination

Upon termination:

  • Your license to use the App immediately ceases
  • You should delete the App from all devices
  • Local data will be removed when you delete the App
  • iCloud data will remain in your account until you delete it

Children’s Use

PingMind is suitable for general audiences. However:

  • We do not knowingly collect data from children under 13
  • Parents/guardians should supervise children’s use
  • Children should obtain parental permission before using the App

If we learn that we have collected information from a child under 13, we will delete it (though we don’t collect data from any users).

Geographic Restrictions

The App is available worldwide through the App Store. However:

  • Certain features may not be available in all regions
  • You are responsible for compliance with local laws
  • We make no representation that the App is appropriate for use in all locations

Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where LimStack operates, without regard to conflict of law principles.

Dispute Resolution

If you have any disputes or concerns:

  1. First contact us at [email protected]
  2. We will attempt to resolve the issue informally
  3. If unresolved, disputes may be subject to binding arbitration or court proceedings as permitted by law

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LimStack regarding the App and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Acknowledgment

By using PingMind, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms
  • You are at least 13 years of age (or have parental consent)
  • You have the authority to enter into this agreement
